How do I get a US investor visa? Answers to frequently asked questions about the EB-5 program.

How does the EB-5 program work?
A foreign investor can get a residence permit (green card) for an investment of $ 900 thousand in a new commercial project in the United States. Together with the investor, the residence permit will be issued to his family members: spouses and children under the age of 21 who are not married.

The EB-5 program was introduced by Congress in 1990 to stimulate the US economy: attracted investment creates jobs for US citizens. In 1992, the Congress adopted a pilot program for Regional Centers called the “Regional Centers Program”.

How much will an EB-5 visa cost?
From November 21, 2019, the minimum investment amount was increased from $ 500,000 to $ 900,000 for TEA projects (an area with a high unemployment rate). For all other projects – $ 1.8 million.

How long will it take to get an EB-5 green card?
The term for obtaining a green card under the EB-5 program depends on the citizenship of the investor. China, India and Vietnam face long waits to process petitions due to increased demand for participation in the program.

For other foreign citizens, the processing time of the application (petition I-526) is from two and a half to four years. In 2020, we adopted new rules for reviewing petitions, which should significantly speed up the processing process for Russian citizens.

Who can apply for an EB-5 visa?
Any citizen can get a visa. The EB-5 program does not contain requirements for language proficiency, profession, or age. The main requirements of the program are the legality of receiving invested funds and the absence of a criminal record.

How many EB-5 visas are issued annually?
There is an annual limit for issuing EB-5 — 10 thousand visas, which takes into account investors and their family members.

Can I use credit funds to invest under the EB-5 program?
EB-5 investment capital can be derived from a loan, gift, income, asset sale, inheritance, or other sources. The main thing is that the investment was received in a legal way.

Is it possible to return the investment?
According to the law, the EB-5 Program cannot guarantee a return on investment. Therefore, the return on invested funds will depend on the ability of the business to generate profit. In the case of a Regional center, it depends on the reliability of the project.

At the moment, there are a number of Regional centers that provide return on investment statistics for their projects. On average, if funds are invested in a reliable Regional center project, the investment can be returned in 5-7 years.

How can I simplify the process of participating in the EB-5 program with the help of a Regional center?
There are two ways to invest under the EB-5 program: directly (your own business) or through Regional centers.

The regional center is a commercial organization licensed by the United States citizenship and immigration services (USCIS), established to help with the EB-5 investment process.

The regional center works with a certain staff and offers projects for investment in this region, as well as monitors compliance with the conditions of the EB-5 Program when investing by foreign citizens.

Most often, participants of the program invest in projects of Regional centers, because:

regional centers make it easier to meet the requirements of the EB-5 program to create new jobs for US citizens;
